A new Regulation published in the Official Gazette on May 26, 2025, updates the implementation principles of the Anti-Smuggling Law No. 5607. The Ministry of Trade's regulation strengthens legal harmony in combating smuggling.

New Regulation Published in Official Gazette: Significant Update in Anti-Smuggling Law Implementation!

ANKARA – A crucial update has been made to the implementation principles regarding seized goods and detained vehicles under the Anti-Smuggling Law (Law No. 5607), as per the new Regulation amendment published in the Official Gazette on May 26, 2025. This regulation, prepared by the Ministry of Trade, strengthens legislative harmony by updating the article references of the relevant Decree Law. Anti-smuggling processes, closely monitored by the public, are now set within a new legal framework with this amendment.

A significant legal step was taken with the publication of the "Regulation Amending the Regulation on Seized Goods and Detained Vehicles under Law No. 5607 on Combating Smuggling" in the Official Gazette, Issue No. 32911, dated Monday, May 26, 2025. This Regulation, drafted by the Ministry of Trade, aims to update the existing framework in the field of combating smuggling, thereby establishing a more effective ground for implementation.

Legislative Harmony Ensured: Authorization Articles Updated

Article 1 of the newly published Regulation amends Article 2 of the original Regulation, which was published in the Official Gazette dated 14/11/2013, Issue No. 28821. The phrase "Articles 15 and 28 of the Decree Law No. 640 on the Organization and Duties of the Ministry of Customs and Trade dated 3/6/2011" has been changed to "Article 458/B of the Presidential Decree No. 1 on the Presidential Organization."

This amendment is of great importance for ensuring the harmony of the relevant legislation with the current Presidential Decrees. Previously, the Regulation referred to articles of the former Decree Law concerning the organization and duties of the Ministry of Customs and Trade. With the new regulation, it has been aligned with the relevant authorization article in the Presidential Decree on the Presidential Organization. This signifies that the legal basis for the management of seized goods and detained vehicles in anti-smuggling operations is now placed on a more robust and up-to-date foundation.

Impact on Anti-Smuggling Processes

This amendment is expected to reflect positively on the field practices of security units and relevant ministries involved in combating smuggling. Increasing legal clarity in the transfer, liquidation, or other related processes of seized goods and vehicles could contribute to faster and smoother execution of these procedures.

The same issue of the Official Gazette also included other Ministry of Trade Communiqués, such as the lists of Inward Processing Authorization Certificates (D1), Domestic Sales and Delivery Certificates (D3), Outward Processing Authorization Certificates (H1) for April 2025, and the list of Inward Processing Authorization Certificates canceled at the request of firms. In the Judiciary Section, Constitutional Court decisions also drew attention.

These updates demonstrate Türkiye's determination in combating smuggling and its continuous effort to improve its legislative infrastructure.
