Official Gazette July 1, 2025: Comprehensive Overview of Laws, Presidential Decrees, and Regulation

Ankara – The Official Gazette (Resmî Gazete) dated July 1, 2025, and numbered 32943, has been published, featuring a wide array of legislative changes, presidential decisions, new regulations, and various announcements. This edition outlines significant amendments to existing laws, crucial executive decisions, new statutes for sports federations, and important communiqués affecting various sectors.

Legislative Section

The primary highlight in the Legislative Section is Law No. 7551 on Amendments to Certain Laws and Decree-Laws. This comprehensive law introduces several key changes:

• Public Officials' Expense Law (Law No. 6245): Amends Article 29 to include "Vice Presidents and Ministers" after "Vice Presidents" and adds "Secretary-General of the Presidency" after "President of the Constitutional Court," while removing "Ministers" and "Head of Administrative Affairs of the Presidency".

• Law on Betting and Chance Games in Football and Other Sports Competitions (Law No. 7258): Article 2, previously annulled by the Constitutional Court, has been re-regulated. It now explicitly details the authority of the Spor Toto Organization Presidency to determine and evaluate dealership locations, numbers, and applications, as well as to conduct necessary audits and controls.

• Turkish Armed Forces Personnel Law (Law No. 926): Re-regulates the second sentence of Article 30, First Paragraph, allowing the President to extend or shorten service periods.

• Military Schools, Military Students, Military Factories, and Certain Regulations Law (Law No. 1325): Amends Annex Article 15 to grant customs duty exemption for vehicles, machinery, equipment, and mine-sniffing animals brought from abroad for humanitarian demining activities by the Ministry of National Defense.

• Higher Education Law (Law No. 2547): Re-regulates Article 6 (b) concerning the composition of the Council of Higher Education (YÖK), which will now consist of 21 members selected by the President, the Interuniversity Board, and those appointed directly by the President. It also amends Article 13 (a), stating that rectors for state and foundation universities are appointed by the President, with foundation university rectors appointed upon the proposal of the board of trustees. Furthermore, Article 34 is re-regulated to limit the number of foreign academic staff to 2% of the total filled academic staff positions, with details on their distribution, salaries, and contract approvals managed by YÖK.

• Highway Traffic Law (Law No. 2918): Changes the phrase "Head of Administrative Affairs of the Presidency" to "Secretary-General of the Presidency" in the attached list (1).

• Youth and Sports Services Law (Law No. 3289): Re-regulates the repealed Article 35, allowing for the establishment of coordination offices abroad for the Ministry of Youth and Sports, with their operational procedures and personnel details to be determined by the President.

• Law on the Establishment, Working Principles, and Methods of the Economic and Social Council (Law No. 4641): Amends Article 2, stating that the members of the Council are determined by the President, and Article 4, which stipulates that the Council's working procedures and principles are also determined by the President.

• Public Officials' Trade Unions and Collective Bargaining Law (Law No. 4688): Re-regulates a phrase in Article 19 regarding foundations granted tax exemption by the President.

• Municipal Law (Law No. 5393): Amends Article 4 to allow the establishment of municipalities in newly settled areas with a population of 5,000 or more. Article 11 is re-regulated to merge municipalities and villages whose populated areas are within 5,000 meters of an affiliated provincial or district municipality with a population of 50,000 or more, and to convert municipalities with populations below 2,000 into villages.

• Law on Monitoring and Auditing State Supports (Law No. 6015): Annex Article 2, previously annulled, is re-regulated to state that references to the State Supports Monitoring and Auditing Board will now be considered as references to the board or authority determined by the President.

• Law on the Establishment and Trial Procedures of the Constitutional Court (Law No. 6216): Re-regulates Article 57 (2) regarding High Criminal Court trials for the President, Vice Presidents, and ministers, specifying a three-month completion period, extendable by an additional three months. It also re-regulates temporary Article 2 concerning the trial of former Council of Ministers members and former military judicial officials in the High Criminal Court.

• Occupational Health and Safety Law (Law No. 6331): Re-regulates Annex Article 1, stating that references to the National Occupational Health and Safety Council will now refer to the board or authority determined by the President.

• Law on Certain Regulations Regarding Çanakkale Wars Gallipoli Historical Area (Law No. 6546): Re-regulates Article 10 (2) to allow the President to increase certain rates up to twofold. Article 11 is also re-regulated, exempting the Presidency's activities related to the Historical Area (such as event organization, restoration, and promotion) from certain provisions of the Public Procurement Law, excluding penalties and participation prohibitions.

• Law on the Acceptance of Decree-Law No. 6756 (Law No. 6756): Re-regulates Article 5 (3) to state that the rector of the National Defense University is appointed by the President.

• Security Investigation and Archive Research Law (Law No. 7315): Changes the phrase "Head of Administrative Affairs" to "Secretary-General" in Article 7 (1).

• Decree-Law on Public Economic Enterprises (Decree-Law No. 233): Re-regulates Article 3 (3) to allow enterprises to be established as anonymous companies without a general assembly. Annex Article 2 is also re-regulated, exempting state-capitalized companies established as anonymous companies by the President from certain provisions of the Turkish Commercial Code regarding establishment, registration, capital injection, and general assembly. Defense, security, or intelligence-related anonymous companies are also exempt from audit and group of companies provisions.

• Decree-Law on Support and Price Stability Fund and Certain Regulations (Decree-Law No. 637): Re-regulates Article 26 to establish a revolving fund enterprise within the Ministry of Trade for various activities, including foreign trade inspections, laboratory operations, promotion, and customs inspections. The initial capital is 500,000,000 TL, which can be increased up to five times by the President.

• Decree-Law on Private Accommodation Services and Certain Regulations (Decree-Law No. 652): Re-regulates Article 13 to centralize the issuance of opening and operating licenses for private student accommodation institutions. The Ministry of National Education will handle middle and secondary education levels, while the Ministry of Youth and Sports will manage higher education levels. These ministries can delegate their authority to provincial governorships.

• Decree-Law on the Execution of Legal Services in Public Administrations within the General Budget and Special Budgets (Decree-Law No. 659): Changes the phrase "Head of Administrative Affairs" to "Secretary-General" in Article 5 (3).

• Decree-Law on the Organization and Duties of the Public Oversight, Accounting, and Auditing Standards Authority (Decree-Law No. 660): Re-regulates Article 5 (2), stating that the duties of the Board Chairman and members can only be terminated by the President under specific conditions such as serious illness, loss of required qualifications, or non-compliance with Article 6.

The law will come into force on the date of its publication, and its provisions will be executed by the President

Executive and Administrative Section

This section includes several Presidential Decisions:

• Decision No. 10019: Amends Presidential Decision No. 7700, dated 05/10/2023, regarding grants and construction loans for real or legal persons owning parcels where new structures will be built under Annex Article 1 of Law No. 7452, which covers settlement and construction within the scope of the State of Emergency.

• Decision No. 10020: Concerns the implementation of tariff quotas on the import of certain industrial products.

• Decision No. 10021: Amends the Import Regime Decision.

• Decision No. 10022, 10023, 10024: Relate to the urgent expropriation of certain immovable properties by the General Directorate of Turkish Electricity Transmission Corporation (TEİAŞ) for various energy transmission line projects, including the 154/33 kV Hanönü Transformer Center, 400 kV Saros Havza Transformer Center, and 154 kV Armutçuk WPP TM-Şapdağı WPP TM Energy Transmission Line.

• Decision No. 10025: Concerns the establishment of certain vocational schools, faculties, and institutes, as well as the closure of some and the renaming of others.

Regulations

Two key regulations have been published:

• Regulation Amending the Regulation on Fire Protection of Buildings (Decision No. 10026): Introduces changes to existing fire safety rules for buildings.

• Presidential Rapporteurship Regulation: Details the operational principles of the Presidential Rapporteurship.
